Federal Litigation
The Talc MDL: Latest Developments
(MDL 2738 — District of New Jersey)
The federal talc cases are centralized in MDL 2738 in the District of New Jersey — one of the largest active MDLs in the country. The MDL remains fully active, and no global settlement has been approved.
- Over 53,000 cases remain pending in the MDL as of 2026
- Multiple rounds of “Daubert” challenges, with courts repeatedly scrutinizing expert testimony on asbestos contamination and causation
- In 2024–2025, the MDL court reopened expert proceedings, allowing updated scientific evidence and strengthening plaintiffs’ positions
- New filings continue as more individuals link long-term talc use to ovarian cancer, fallopian tube cancer, and primary peritoneal cancer
Settlement Landscape
J&J's Bankruptcy Attempts & the Current Settlement Status
In an unprecedented strategy, J&J attempted to resolve all talc claims through a subsidiary bankruptcy — known as the “Texas Two-Step” — by creating LTL Management LLC. Courts rejected both the 2021 and 2023 bankruptcy filings, ruling that J&J was not in financial distress and could not use bankruptcy to shield itself from jury trials.
In 2024–2025, J&J proposed a $6.48 billion global settlement, but plaintiffs’ leadership and many state attorneys general opposed it, arguing the amount was insufficient and the structure unfair.
- No global settlement has been approved as of 2026
- Third bankruptcy attempt ongoing — J&J continues to pursue this strategy
- State-court verdicts continue — plaintiffs are winning significant awards outside the MDL
- Negotiations remain unresolved — settlement discussions are active but no deal is final
