J&J's Bankruptcy Attempts & the Current Settlement Status

In an unprecedented strategy, J&J attempted to resolve all talc claims through a subsidiary bankruptcy — known as the “Texas Two-Step” — by creating LTL Management LLC. Courts rejected both the 2021 and 2023 bankruptcy filings, ruling that J&J was not in financial distress and could not use bankruptcy to shield itself from jury trials.

In 2024–2025, J&J proposed a $6.48 billion global settlement, but plaintiffs’ leadership and many state attorneys general opposed it, arguing the amount was insufficient and the structure unfair.
